IHSAA Contract - Avoiding Indy Court Mandate

Previously I detailed the contractual provision in the IHSAA "Consent & Release Certificate" really a contract that forces any lawsuit between an athlete and IHSAA to be heard in Marion County (Indy). The location of a court is called venue. It's kind of like jurisdiction, but not at all. The difference is confusing to keep us regulars guessing.

For any skeptics and those not concerned, let's look at an example.

Kids in IHSAA Sports? Better Know Judge Welch

...and Indy courts

...and an attorney that is frequently successful in Indy courts, even though it probably won't matter.

If you have kids in IHSAA sponsored sports, and you end up in court for any reason, no matter who files suit, you might be surprised to discover that court will be in Marion County (Indianapolis). You might be even further surprised that IHSAA might pick a specific judge, who is Judge Heather Welch.

My Response to Valeo's Interest in Settlement

After a hearing in January 2016, Valeo's attorney, Andrew Hull, stated that Valeo was interested in discussing settlement for the second time. I will detail the first offer at a later date, but felt led to share this given the backstory included. What follows is my entire response sent to Valeo owners John Trott, John Wortman, Rick Evans, Timothy Ginn, COO Greg Fulk, and Mr. Hull.
